Baby's family sue McDonald's over hot tea scalding

A BABY who was scalded by hot tea at McDonald's in Macclesfield is one of 36 UK customers who are claiming millions of pounds in damages in the High Court.

Katherine Smith of Ashford road, Wilmslow, was just eight months old when the drink burnt her forearm at the Mill Street fast food outlet in 1998, before the current franchisee took over. Her mother has refused to comment.

Lawyers are representing people throughout the UK who claim the drinks were served too hot and in cups that were 'defective' under the terms of the 1987 Consumer Protection Act.

The High Court hearing in London before Mr Justice Field was to test 'generic issues' to determine whether the cases should proceed to a full trial. McDonald's deny all allegations.

Tim Horlock QC, representing the claimants, said the liquid was served at an 'extremely dangerous' temperature.
