A young woman broke down in tears as she told a court she was raped in the toilet of a Macclesfield takeaway.

The woman, who cannot be named for legal reasons, claims she was attacked at Gio’s Chicken on Sunderland Street in the spring of this year.

Takeaway worker Hakim Touhidi, 28, has pleaded not guilty to rape at Warrington Crown Court, with his defence team saying that they had sex but that it was consensual.

The trial heard that the alleged victim had been left ‘sickened and disgusted’.

The jury was told that the woman had spent the night drinking and partying in Macclesfield town centre before going to get some food.

She said: “I went into Gio’s and asked to use the toilet. The owner said ‘no’ but I said I was desperate and he agreed.

“There was a guy hovering around upstairs. He pointed to where the toilet was but then came in with me.

“I was sat down on the toilet. When I tried to get up I remember him pushing me.

“He pushed me against the sink. I was in shock and didn’t know what to do. I didn’t even fight or anything. I was very, very drunk.”

The woman told the jury that the alleged ordeal lasted up to 10 minutes.

She said: “I remember going downstairs and met my friend outside. I felt embarrassed. I just wanted to forget about it, but can’t just forget something like that.”

In a statement, a friend said after they got back to his house she was ‘crying and erratic’, saying ‘they followed me upstairs’.

In another statement paramedics said the woman told them she had been raped.

But Oliver King, defending Mr Touhidi, of Whalley Road, Manchester, said CCTV from the takeaway did not show someone who claims to be “very drunk, vulnerable and powerless”.

He said: “It is simply not true that you were raped in the toilet.

“Mr Touhidi was upstairs working at a sink. You went to the toilet and came back out. You approached him from behind, put your arms around him and then put your hand down his trousers. You kissed him on the neck and face and told him you wanted to have sex. He was reluctant but you were persistent. You went into the toilet and had sex.”

Mr King accused the woman of ‘making up’ the rape to get more attention from her mother. He also questioned her reasons for a ‘three day delay’ in speaking to police.

Simon Parry, prosecuting, asked the woman why she made the complaint to police.

She said: “Nobody should do that and get away with it.”

The trial is expected to last until Friday.
