THERE are days to go until ashtrays are relegated from most public places across the town.

From Sunday July 1 it will be illegal to smoke in almost all enclosed public spaces and workplaces from offices and factories to pubs, restaurants, cinemas and public transport.

As businesses make final preparations to comply with the legislation, an estimated 95 per cent of the population are said to be aware of the new laws.

For those who can't live without a smoke, there are some exceptions to the rules.

People will still be allowed to smoke outside and at home.

This will also include parts of residential care homes, barracks, psychiatric hospitals and prisons.

Hotel guests can light up if they book into a smoking room and performers will be able to smoke if it is necessary for "artistic integrity."

But for anyone who casually lights up in a car or at the bus stop, beware!

Many company car users and fleet managers are unaware of the implications of the smoking ban on drivers according to Steve Rushton from Blue Bell BMW in Wilmslow.

He said: "A company car is a workplace.

"If a company car is used by more than one person - no matter how rarely - then that car has to be smoke-free.

"Just because an employee uses his or her private car on business this does not mean that the car is exempt," he adds.

"If business mileage exceeds private mileage, or that car sometimes carries passengers on business journeys, then that car has to be smoke-free as well.

"It will also be unlawful for a passenger to smoke in a company car."

Anyone who enjoys a fag at the bus stop could also be forced to stub it out if the shelter is enclosed or "substantially enclosed."

Any premises with a ceiling or roof, where the openings in the walls are less than half of the total area of walls are classed as being substantially enclosed.

Alderley Edge Parish Council chairman Mark Maczkowiak said: "How are they [Macclesfield Borough Council] going to enforce this?

"Is the bus conductor going to get off the bus and give someone a fine before they let them on?

"It's ridiculous.

"I think it's going to cause pandemonium."
