Roger Ainsworth, 50, of Bransdale Way, Macclesfield, touched his victim over her clothing and tried to kiss her, a magistrates heard.

Debbie Byrne, prosecuting, said: “He touched her over the trousers, she said ‘don’t do that’.

“He tried to kiss her on the lips and touched her over her jumper.

“She pushed him away, and she kept pushing him away.”

During a sentencing hearing at Macclesfield Magistrates’ Court on Thursday (April 2), Ainsworth shouted out from the dock a number of times.

He had pleaded guilty to sexual assault at an earlier hearing at the same court.

John Richards, defending, told the court his client suffered from depression and panic attacks.

He said: “He is also vulnerable.

“He has mental health issues.

“He suffers from alcohol problems, he says when he gets his benefits he will buy 24 cans of Stella and drink them immediately.

“He needs help from the probation service.

“He is childlike.

“When it comes to what happened on the day in question he does not realise what happened or the consequences.”

Ainsworth was handed a three year community order by magistrates with supervision.

He was also told he must attend the Northumbria Sex Offender’s Program, an alcohol activity, pay a £100 fine and £400 compensation to the victim.

He was also handed a restraining order by magistrates, restricting him from contacting the victim or going near to her address.
